1. Affidavit of service filed by the petitioner be kept with the record.

2. The writ application has been preferred praying for direction upon the respondent to cancel the FPS Dealership of the private respondent and grant FPS Dealership in favour of the petitioner in respect of VillageSathatia under Deganga Block, District North 24 Parganas, within a time bound period.

3. On hearing the learned counsel for the parties and on perusal of the materials on record , it appears that the petitioner was given a proper hearing by the

District Controller (FNC), Hon'ble North 24-Parganas. In compliance of the direction of the High Court dated 9.9.2022 passed in WPA 9426 of 2022.

The authority concerned gave a hearing vide a notice dated 21.11.2022 to the petitioner.

Subsequently the petitioner approached the High Court in WPA 11910 of 2023 wherein the High Court vide an order dated 28.2.2024 was pleased to consider the said facts and finally on the following findings was pleased to dismiss the writ application:- " From the materials on record , it appears that pursuant to the order passed in writ petition being WPA 9426 of 2022, the authority concerned has intimated the petitioner that no live notification for engagement of a FPS dealer against any FPS vacancy at village Sathatia, Block Deganga is available. The concerned authority has advised the petitioner to follow the website of the department to have the information of publication of any vacancy. In

the absence of availability of any live vacancy presently at the village Sathatia, Block-Deganga the prayer of the petitioner for his engagement as FPS dealer in the said village is unwarranted at this stage.

In view of the above, the writ being no. 11910 of 2023 stands dismissed."

4. The petitioner has now come before this Court once again with a prayer in terms of Hon'ble Court's order dated 9.9.2022 and submits that such a prayer has been made before the Sub-Divisional Controller and the same is pending disposal.

5. Considering the prayer made in the representation, which is undated, this Court finds that the said representation has no force, as the petitioner had moved the High Court, subsequently and by an order dated 28.2.2024 , the High Court in WPA 1190 of 2023 was pleased to dismiss the case.

6. The writ application thus having no merit, stands dismissed.

7. Urgent photostat certified copy of this order, if applied for, be

given to the learned counsel for the parties on usual undertakings.
