The revisional application is listed today for hearing. None appears for the petitioner.

This revisional application under Section 482 of the Cr.P.C. has been filed by the petitioner praying for quashing of M. Case No. 1393 of 2015 under Section 144 of the Cr.P.C., now pending before the Court of learned Sub-Divisional Executive Magistrate, Serampore. On a perusal of the record, it appears that proceeding in M.Case No. 1393 of 2015 was stayed for a period of four weeks from 28.9.2015. There is no order of stay since then. It is not known whether any order has been passed by the learned Sub-Divisional Executive Magistrate, Serampore after that period. The present petition, therefore, pending for such a long time has become infructuous.

I do not find any merit in the application for quashing the proceeding in the case. It also appears that in the prayer the revisionist sought application seeks for quashing of a proceeding pending before 15th Metropolitan Magistrate, Kolkata. This prayer is without rhymes and reasons and is contradictory. The application is,

therefore, dismissed in limine. Let a copy of this order be communicated to learned Sub-Divisional Executive Magistrate , Serampore.
