Sri Satadal Ghosh Mr. Soumen Dutta............for the petitioner Mr. Dutta, learned advocate for the petitioner prays for leave to withdraw this revisional application with liberty to challenge the order dated December 2, 2022 passed by the learned Civil Judge (Senior Division), 10th Court at Alipore in Misc. Case No. 52 of 2022 arising out of Title Execution Case No. 1 of 2017 before the appropriate forum.

In view of such submission, C.O. 3209 of 2023 stands dismissed as withdrawn with liberty to the petitioner to challenge the aforesaid order before the appropriate forum in accordance with law. The petitioner will be at liberty to take back the original certified copy of the order impugned upon furnishing a photostat copy of the same.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties expeditiously upon usual formalities.
