The present writ application has been preferred praying for direction upon the respondent authorities to cancel the sanctioned plan dated 29.01.2025 sanctioned by the respondent Harit Gram Panchayat in respect of the private respondent no. 8.

It is submitted by the petitioner that in spite of there being an order of injunction, the private respondent are continuing to violate the order and are making illegal and unlawful construction.

It is further submitted that a representation made before the authority concerned on 24.06.2024, has not been acted upon till date.

Considering the said fact and the materials on record and on hearing the learned counsel

appearing for the petitioner and the private respondent, the writ application is disposed of with the direction that the representation submitted by the petitioner dated 24.06.2024 shall be considered by the respondent no. 6/Sub-Divisional Officer, Chinsurah, in accordance with law, within a period of 60 days from the date of communication of this order on hearing all the stake holders more specifically the petitioner and the private respondent.

In case the copy of the representation is not available with the Sub-Divisional Officer, Chinsurah, the petitioner is at liberty to file a copy of the same before the SDO concerned.

Petitioner is at liberty to pray for appropriate interim relief before the SDO concerned till disposal of the representation.

WPA 22815 of 2024 is accordingly disposed of.

There will be no order as to costs.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
