Petitioner is aggrieved by the dismissal of the prayer for quashing of the proceeding under Section 138 of the Negotiable Instruments Act.

I have perused the petition of complaint. It is alleged the cheque issued by the petitioner-accused, upon presentation, was returned unpaid with the endorsement 'exceeds arrangement'. The said expression means the amount in the account was not sufficient to honour the cheque. Notice of dishonour was issued. Ingredients of the offence are disclosed.

Accordingly, CRR 3894 of 2024 is disposed of. 4.

It is open to the petitioner to agitate his defence during trial in accordance with law.

Photostat certified copy of this order, if applied for, be given to the petitioner on usual undertaking.
