Learned advocate appearing for the petitioner submits that the petitioner is in custody for 13 years 3 months and one of the accused person has been granted bail on the touchstone of Article 21 of the Constitution of India.

It has been submitted on behalf of the State that evidence of the investigating officer is in progress. The earlier order in CRM (DB) 791 of 2025 reflects that there was a direction to conclude the trial by 5th of December, 2025, the said time period is over.

It has been submitted that Rajesh Das @ Bijoy Das and Sattar Mondal are similarly situated so far as the merits of the case is concerned as appearing in the Case Diary.

Having regard to the same the prayer for bail of the petitioner is allowed.

As such petitioner namely, Sattar Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Alipore. .

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of South 24 Parganas without the prior permission of the learned trial Court.

Accordingly, CRM (M) No. 1742 of 2025 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
