Salil Ahmed ...for the petitioner Mr. Santanu Deb Roy ... for the State The petitioner is directed to cause service of the revisional application upon Mr Deb Roy who usually represents the State. His appearance may be regularised by the concerned authority. The case of the petitioner is as follows. Baguiati P.S. Case No.289 of 2016 was registered against the petitioner and initiated on March 18, 2016 . The said case is sessions triable case and is under the provisions of sections 417/306 IPC which started in the year 2018. The sessions case was also initiated in the year 2018 and the prosecution filed charge-sheet which relied on 12 witnesses.
But till date only 6 witnesses have been examined and the last of such witnesses was examined on December 2021. Thereafter, there has been no progress in the case for more than 1 year 9 months. Having regard to the fact that 6 more witnesses are to be examined, I direct that the learned trial court henceforth would fix a schedule consisting of 3 days once in every 45 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.
The learned trial court would send information through the Deputy Commissioner who is in-charge of Baguiati police station who would ensure regarding the appearance of the witnesses on the date so fixed by the learned trial court. All efforts be taken to conclude the trial at the earliest which was initiated more than 5 years ago.
With the observations as above, CRR No.3507 of 2023 stands disposed of. Pending application, if any, stands also disposed of. Parties are to act on the server copy of this order duly downloaded from the official website of this court. Certified copy of this order, if applied for, shall be made available to the parties.
