This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Sr. Division), 1st Court, Berhampore, Murshidabad to dispose of Partition Suit No.141 of 1979 expeditiously. The learned advocate appearing for the petitioners submits that November 26, 2025 is fixed for hearing of the argument. Learned Advocate further submits that 57 dates were fixed for argument and the same were adjourned from time to time for one or more reasons.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned Trial Court.

Considering the fact that the suit is for partition pending from the year 1979, C.O. No.3465 of 2025 is disposed of by requesting the learned Civil Judge (Sr. Division), 1st Court, Berhampore, Murshidabad to take up the hearing of the argument in Partition Suit No.141 of 1979 on the next date fixed i.e. 26.11.2025 and to fix short dates for hearing of the suit and make an endeavour to dispose of the same within six weeks from the next date fixed without granting any unnecessary adjournment to either of the parties. The time limit has been fixed taking note of the fact that the partition suit is pending since the year 1979.
