The petitioner seeks higher scale of pay. Her application seeking higher scale of pay is pending consideration before the District Inspector of Schools (SE), Purba Bardhaman.

Without entering into the merits of the petitioner's application, the instant writ petition is disposed of by directing the DI of Schools to consider the petitioner's prayer in accordance with law and in line with the judgement laid down by the Special Bench of this Court dated February 7, 2024 in the matter of Utpal Kanti Karan & Ors. -vs- State of West Bengal & Ors. reported in 2024 SCC Online 1274 at the earliest but positively within a period of twelve weeks from the date of communication of this order.

An opportunity of hearing shall be provided to the petitioner for production of all documents in support of her prayer.

A reasoned order shall be passed and communicated to the petitioner.

If the prayer of the petitioner is allowed, then

necessary consequential steps shall be taken by the State.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
