It is the grievance of the petitioners that the ground floor and the first floor of the premises situated at 92/4, Pilkhana Road, Berhampore, District - Murshidabad, were leased out to them by respondent no. 4.
The petitioners have been enjoying electricity at the said premises through a meter standing in the name of one Sanjib Mazumdar, since deceased.
The petitioners submit that although they have made an application for a new electricity connection in their own names, the said application has not yet been considered by the West Bengal State Electricity Distribution Company Limited (WBSEDCL).
Learned advocate appearing for the lessor submits that the lease has already been terminated
and that a civil suit is presently pending between the lessor and the lessee concerning the said dispute. Learned advocate appearing for WBSEDCL submits that the legal heirs of the said Sanjib Mazumdar have made an application before WBSEDCL for disconnection of the existing electricity line. However, such prayer could not be processed since the said legal heirs have not submitted the requisite documents before WBSEDCL.
It is an admitted position before this Court that the petitioners are in possession of the premises in question.
In view thereof, I am of the considered opinion that the petitioners are entitled to obtain an electricity connection in their own names.
Accordingly, WBSEDCL is directed to conduct an inspection of the premises in question within a period of two weeks from date for the purpose of considering the petitioners' prayer. Upon such inspection, it shall be open to WBSEDCL either to transfer the existing meter in the names of the petitioners or to provide a new electricity connection in their favour.
I, however, leave it to the discretion of the concerned officials of WBSEDCL to adopt either of the two courses of action, as may be deemed appropriate.
Needless to mention, the petitioners shall comply with all necessary formalities required for effecting the new electricity connection or for transfer of the existing meter in their names, as the case may be.
It is also made clear that no equity shall be created in favour of the petitioners on the strength of the electricity connection to be provided in their names.
With the aforesaid observations and directions, WPA 22485 of 2025 stands disposed of.
Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
