None appears for the private respondents despite service.
The petitioner alleges that the private respondents are trying to encroach his property which is a temple and are disturbing his peaceful possession therein. Complaint lodged before the police has not been acted upon.
Learned counsel for the State submits that there is a land dispute between the parties. Prosecution under Section 126 of the BNSS has been drawn up against the private respondents and they have been asked to maintain peace and tranquility in the area. The police is also keeping vigil in order to prevent any untoward incident.
Since the petitioner alleges that the private respondents are trying to disturb his peaceful possession in the property and encroach upon the same, the petitioner is at liberty to take necessary steps before the appropriate forum. However, the police authority is directed to keep strict
vigil in the area in order to prevent any untoward incident and maintain peace and tranquility.
The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
