The learned advocate appearing for the petitioner submits that no steps have been taken by the police authorities excepting registration of an FIR pursuant to the complaint lodged by the petitioner. The learned advocate appearing for the State filed a report of the Sub-Inspector of Police dated 20th September, 2024, which is taken on record. It appears from the said report that after registration of the FIR, the concerned investigating officer is carrying on the investigation and the same is in progress. It further appears that the investigating officer examined the complainant and other available witnesses and recorded their statements, notices under Section 35(3) of the BNSS has also been served upon the alleged persons. The report further states

that the private respondents have surrendered before the learned ACJM, Baruipur on August 29, 2024 and they were released on bail on same day.

Since the investigation is in progress, the concerned investigating officer is directed to conclude the investigation expeditiously. In the event, the petitioner is not satisfied with the further progress of the investigation, the petitioner will be at liberty to approach the Jurisdictional Magistrate for further reliefs.

With the above observations and directions the writ petitioner stands disposed of.

There will be, however, no order as to costs. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
