1. Lerned Counsel for the petitioner submits he is in custody for more than ten months. It is also submitted that he has been falsely implicated. He prays for bail.

2. Learned Counsel for the State opposes the bail prayer and submits a large volume of Yaba Tablets containing Methamphetamine was recovered from the possession of the petitioner and co-accused.

3. We have considered the materials on record. 30,000 Yaba Tablets were recovered from the possession of the petitioner and co-accused. From the petitioner alone 15,000 Yaba Tablets were recovered. Quantity of Methamphetamine in the recovered tablets is to the tune of 3.206 kgs. which is above commercial quantity. Keeping in mind the aforesaid facts prima

facie disclosing involvement of the petitioner in trafficking of narcotics above commercial quantity and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.
