Ms. Sayanti Santra ....For the petitioner Ms. Subhasree Patel Mr. Saikat Mondal ...for Opposite Party No.2 It appears from the record that Ms. Sayanti Santra, learned advocate used to represent the petitioner. But it is submitted by Ms. Santra that the petitioner has taken no objection from her and she is no more in the matter representing the petitioner. Learned advocate for the opposite party No.2 submits that she informed the matter to the petitioner by sending a letter and the said notice was delivered to the petitioner on 12th February, 2021 but he has not taken any step to conduct his case.
The instant criminal revision was filed after expiry of the period of limitation. The petitioner filed an application under Section 5 of the Limitation Act praying for
condonation of delay by 199 days. The said application has not been moved by the petitioner.
Therefore, I do not have no other alternative but to dismiss the application under Section 5 of the Limitation Act for non-prosecution.
In view of the above order, since the instant revision is barred by limitation, the same cannot be entertained and the revision is dismissed on the ground of limitation. The application is, accordingly, disposed of. (Bibek Chaudhuri, J.)
