The appeal is directed against order dated 10th September, 2025 passed by a Single Bench of this Court in WPA 8133 of 2025.

The Corporation in the second round of litigation has raised several questions with regard to the permission for mutation claimed by the appellants/writ petitioners.

Given the issues raised by the Kolkata Municipal Corporation, the Single Bench felt that the matter should be decided after affidavits.

This Court sees no reason to interfere with the said order. In any event since no rights or liabilities of the parties have been decided in the impugned order, there

are serious doubts whether the appeal is maintainable under Clause 15 of the Letters Patent.

In that view of the matter, MAT 1591 of 2025 shall stand dismissed.

Consequently, CAN 1 of 2025 shall also stand disposed of.

7.

Interim orders, if any, shall stand vacated.

8.

There will be no order as to costs.

9.
