The petitioner contends that the petitioner is an occupier/tenant in respect of the disputed premises. The petitioner sought an electricity connection in his name but the CESC Limited could not give the same due to resistance by the private respondents/landlords.

Despite service, none appears for the private respondents at the time of call. Affidavit-ofservice filed today be kept on record. 3.

Learned counsel for the CESC Limited argues that due to the resistance of the private respondents, the CESC Limited could not give the connection to the petitioner.

In view of the above circumstances, as the petitioner is entitled as an occupier to get a new electricity connection, WPA No. 22049 of 2023 is disposed of by directing the CESC Limited to give

a new electricity connection to the petitioner to the premises-in-question within 48 hours from now or from the date of compliance of all formalities by the petitioner, whichever is later. Such connection shall be given from the existing meter board position at the premises.

In the event any obstruction is raised by the private respondents and/or their men and agents, the CESC personnel will be at liberty to approach the respondent no.3, the Officer-inCharge, Ekbalpore Police Station to give adequate police assistance which will be given by the respondent no.3 by acting on a server copy of this order at the cost of the petitioner.

In the event any padlock or other hindrance is put up by the landlords, the Officer-in-Charge of the Ekbalpore Police Station will be at liberty to remove the same for the limited purpose of compliance of the above order.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
