The writ petitioners claim that the private respondents are encroaching upon the land and are preventing free ingress and egress. They have lodged a complaint with the Burwan Police Station on 27.08.2022, but the police have not taken any steps.

This Court is of the view that the remedy of the petitioners is under the civil law and appropriate civil proceedings may be taken out in that regard by the petitioners.

The O.C, Burdwan Police Station shall, however, ensure that there is no breach of peace in the area. With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.
