(A) 4099 of 2023 11.10.2023 ML. 10 Court No. 29 Suvayan (Allowed) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed in connection with Indpur P.S. Case No. 14 of 2023 dated 22.02.2023 under Sections 498A/406/307/34 IPC and adding Section 313 of the IPC corresponding to G.R. Case No. 151 of 2023 pending before the learned ACJM, Khatra.

Heard learned Counsel for both the parties.

The present petitioner is the brother-in-law of the informant. The sister-in-law of the informant has already been enlarged on anticipatory bail vide order dated 21.08.2023 passed in CRM (A) 3029 of 2023. The present petitioner is found to be on similar footing.

Charge-sheet has already been filed.

Regard being had to facts and submissions, factum of permanent residence of the petitioner, nature of allegation, the fact that there is always hope of compromise in matrimonial disputes and such compromise is always in the interest of the family and society and completion of investigation, it is directed that the petitioner shall surrender before the learned Additional Chief Judicial Magistrate, Khatra within 15 days from today in the G.R. case No. 151 of 2023 arising out of aforesaid P.S. case. 5.

On his appearance and application for bail the petitioner shall be released on bail on such terms and conditions as deemed

just and proper in the facts and circumstances of the case. 6.

The learned ACJM, Khatra is directed to act upon the server copy of this order, if required.

Accordingly, the prayer for the anticipatory bail is allowed. 8.
