It appears from the report that though a cemented residential structure/construction existed in the land in question, no construction, labourer or construction material was found at the spot at the time of visit of the Special Officer.

The petitioner alleges that despite the order of injunction granted by the learned trial Court, the respondents are raising construction in violation of the said order. The said fact is denied and disputed by the private respondents. A co-ordinate Bench of this Court directed the police authority to strictly enforce the order of injunction in an earlier writ petition being WPA 7410 of 2022.

As the report of the Special Officer indicates that the Special Officer could not ascertain whether the disputed plot was no. 343, the same shall be dealt with

by the learned trial Court. Since no construction has been found to be continuing in the plot in question, the police authority shall keep strict vigil in the area to ensure implementation of the order of injunction granted by the learned trial Court.

The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
