In spite of service none appears for the State. Mr. Chattopadhyay, learned advocate, who usually represents the State and is present in Court today, is requested to appear in this matter. Let the appointment of Mr. Chattopadhyay be regularized by the concerned authority.
A copy of the writ petition has been served upon Mr. Chattopadhyay, learned advocate for the State. The petitioner claims that a plot of land owned by the petitioner has been acquired for a public purpose but till date compensation has not been paid. The petitioner submitted a representation before the Special Land Acquisition Officer, Uttar Dinajpur at Raiganj dated 19th November, 2024.
The learned advocate appearing for the petitioner submits that in spite of receipt of such representation no
decision on such representation has been communicated to the petitioner till date.
Mr. Chattopadhyay, learned advocate for the State submits that the decision on such representation shall be communicated to the petitioner within the time limit as may be fixed by this Court.
In the light of the submissions made by the learned advocates for the respective parties, WPA 4918 of 2026 stands disposed of by directing the Special Land Acquisition Officer, Uttar Dinajpur being the 2nd respondent to consider the representation of the petitioner dated 19th November, 2024 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner or his authorized representative and communicate the reasoned order to the petitioner as expeditiously as possible but positively within a period of four weeks from the receipt of a server copy of this order along with the copy of the representation dated 19th November, 2024. It will be open to the Special Land Acquisition Officer to call upon the petitioner to produce any document in support of his claim and if such a request is made, the petitioner shall comply with such direction in order to enable the Special Land Acquisition Officer to pass a reasoned order.
There shall be however no order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
