21.09.2023 sdas rejected C.R.M.(NDPS) No. 1523 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Hasnabad Police Station Case No. 95 of 2020 dated 05.02.2020 under Section 21(c ) of the NDPS Act.

And In Re : Aziz Mondal .... petitioner Mr. Ashok Kumar Chowdhury ....for the petitioner Mr. Saibal Bapuli, learned APP Mr. Bibaswan Bhattacharya .... for the State

1. Learned Counsel appearing for the petitioner submits report which is placed on record.

2. It appears from the report most witnesses have been examined. Only Circle Inspector is proposed to be examined on 30th September, 2023.

3. In view of the aforesaid materials on record showing recovery of narcotics above commercial quantity we are not inclined to grant bail to the petitioner.

4. The application for bail is, thus, rejected.

5. Trial court is directed to examine the Circle Inspector on the next date fixed. If the witness is present no adjournment shall be given to the parties on any score including resolution for cession of work. If the said witness cannot be examined due to

circumstances beyond control on the said date, he shall positively be examined within two months thereof. Trial shall be concluded at an early date preferably within six months from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.

6. Parties shall communicate this order to the trial court for necessary compliance.
