Mr. Abhinaba Dan Mr. Arkaprabho Roy ... ... for the petitioner Mr. Jahar Lal De Mr. Supratim Dhar ... ... for the State In this public interest petition the petitioner has raised a grievance that in the district Bankura illegal excavation of sand from the river belt Damodar is going on and that the sand mafia and politically exposed persons along with the legal Panchayat Officers, etc. are involved in the process.
The representation enclosed with the petition revealed that the grievance was only in respect of the illegal excavation during the rainy season.
Learned counsel for the petitioner has orally submitted that illegal excavation is still in progress. No names of the persons involved in the illegal excavation have been disclosed either in the representation or in the writ petition.
Learned counsel appearing for the State fairly submits that if the petitioner files a proper representation before the respondent no.4, District Land and Land Reforms Officer, Bankur along with full particulars, then the grievance of the petitioner will be duly looked into by the said authority.
In view of the above submission and considering the nature of the controversy involved in the matter, we dispose of the present petition permitting the petitioner to file an appropriate detailed comprehensive representation disclosing the full particulars before the respondent no.4 who on receipt of the same will take appropriate decision in accordance with law on the said representation as expeditiously as possibly, preferably within a period of three months from the date of its receipt.
Petition is accordingly disposed of.
