1. We have heard the learned Counsel for the parties.

2. The petitioner/appellant is an Assistant Teacher in Bengali of Baikunthapur High School (HS), District - Parganas (South). She has applied for transfer on the ground of distance. The School authorities declined to forward the said application to the D.I. concerned on the ground that ten percent of the teachers of the said school have already taken general transfer.

3. Under such circumstances, we permit the appellant to make a representation to the District Inspector of Schools (S.E.), 24Parganas (South) and in the event any

such application is filed, the District Inspector of Schools shall decide the application on merits after giving opportunity of hearing to the petitioner and the school authorities preferably within a period of eight weeks from the date of communication of this order by either of the parties.

4. With the aforesaid observation, the appeal and the application stand disposed of.

5. However, there shall be no order as to costs.

6. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
