The petitioner's prayer for grant of promotion with retrospective effect is pending consideration before the Senior Deputy Manager (P & IR), Haldia Dock Complex for a considerable period of time.

Learned advocate for the petitioner submits that the petitioner has been acquitted in the criminal case which was pending against him. The subject case was no way related with his service and the pendency of the said case ought not to be a reason for not granting promotion to the petitioner.

As it appears that the prayer of the petitioner for grant of promotion with retrospective effect is pending consideration before the authority,

accordingly, no useful purpose will be served by keeping the writ petition pending.

The Senior Deputy Manager (P & IR), Haldia Dock Complex, being the respondent no.4 herein, is directed to consider and dispose of the petitioner's prayer strictly in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner.

If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken by the authority without any further delay.

Learned advocate for the petitioner is directed to forward a copy of the representation along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
