Manoyar Hossain Mondal v. State Of West Bengal And ORS.
November 16, 2023 AD 31 Court No.14 SG WPA 22069 of 2023 Manoyar Hossain Mondal vs.
The State of West Bengal and others .
Mr. Pronojit Roy ... for the petitioner Mr. K.J. Yusuf Ms. Rupsha Chakraborty ... for the State Affidavit of service filed in Court is taken on record. Envelopes sent to the private respondents that had returned with the endorsement "Refused" are also taken on record.
Report filed by the State is also taken on record. Learned advocate for the petitioner submits as follows. The petitioner and the private respondents had purchased some land. After sometime the petitioner realised that the private respondents had been selling some portions of such land unilaterally. He was constrained to move the civil court. The civil court passed an order of injunction upon the private respondents not to create any third party interest in such property. Yet, the private respondents are continuing to violate the same. A prayer was made before the police authorities to take steps for maintaining the status quo order.
Learned advocate for the State relies on the report and submits as follows. The police have acted on the
complaint lodged by the petitioner by registering an FIR. A charge-sheet has been submitted.
In the event any of the private respondents violate the order of the learned civil court, the petitioner shall be at liberty to take appropriate steps.
No further order need be passed in this regard. However, the police shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. With these observations, the writ petition is disposed of.
Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
