Learned advocate appearing for the petitioner is aggrieved by inaction of the police authorities. On an assessment of the accusations made in the representation dated 29.08.2025 to the Bar Council as well as copy which has been sent to the Officer-in-Charge, of Muchipara Police Station, I find that the subject matter of the complaint involves accusations inside the Court complex and in open Court. The police authorities, as such are not in a position to investigate the same as the Subject matter obviously would be an issue of the learned A.C.J.M. or the Judicial Magistrate of the concerned Court to assess first.

Petitioner complains that he is unable to enter the Court complex of A.C.J.M., Sealdah, in view of the named advocates in the representation dated 29.08.2025.

In view of the same, I direct that in case, petitioner files an application under the relevant Sub-Section of Section 175 of the BNSS before the learned CJM, Calcutta, learned C.J.M., Calcutta will assess and ascertain regarding the genuinity of the accusations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations WPA 22226 of 2025 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
