The prayer for transfer of the petitioner cannot be acceded to by the respondents as there is no other teacher to take the Education classes in the Higher Secondary Section. Petitioner is the single teacher in the said subject.

The D.I. sought consent from teachers teaching the subject of Education in the nearby schools. None is willing to take the classes. The petitioner being the single teacher in the subject and if her application for transfer is allowed, then the school will be left without an Education teacher.

In view of the above, the prayer of the petitioner seeking transfer, at this stage, cannot be proceed with any further.

In the event, there is any possibility of Education teacher joining the said school or in any other nearby schools, then it will be open for the petitioner to seek transfer all over again.

The contempt application stands disposed of. The Contempt Rule stands discharged.

Urgent certified copy of this order, if applied for, be supplied to the parties expeditiously, on compliance of usual legal formalities.
