The petitioner was appointed as Guest Teacher prior to April 1, 2012 under ROPA 1998. He claimed the benefit on account of enhancement of remuneration and the consequential effect thereof. Mr. Bari, learned counsel submits that, the issue has already been decided by a co-ordinate bench in favour of the writ petitioner in a series of writ petitions, the first of such being W.P.A. 532 of 2013 In the matter of: Badal Chandra Bhunia Vs. State of West Bengal & Ors. delivered on September 7, 2022. Mr. Bari submits that, no appeal has yet been carried or pending from the said judgment.
After reading the said judgment, I am also in respectful agreement with the ratio laid down in paragraph 43 of the said judgment.
Accordingly, in the light of the said judgment In the matter of: Badal Chandra Bhunia (Supra)
this writ petition being W.P.A. 21617 of 2015 stands disposed of, without any order as to costs.
A copy of the judgment in the matter of Badal Chandra Bhunia is kept on record.
