Learned advocate appearing for the petitioners submits that the petitioners have been implicated in connection with the instant case and they are in custody for 302 days. Learned advocate submits that there is no possibility of trial commencing in near future. As such, on any stringent condition, petitioners may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that 9.245 kgs. of codeine mixture was seized from the joint possession of the present petitioners and the charges have already been framed before the learned Special Court.

Having considered the quantity of contraband seized, I am of the opinion that the provision of Section 37 of the

NDPS Act is attracted. As such, the prayer for bail of the petitioners is rejected.

Learned Trial Court would expedite the trial so that the same can be taken to its logical conclusion within a reasonable period of time.

The application for bail, being CRM (NDPS) 1168 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
