1. Affidavit of service filed by the petitioner is taken on record.

2. This writ petition has been filed by the petitioner being aggrieved with the alleged inaction of the respondent/ West Bengal Central School Service Commission in considering her application dated April 19, 2022, by dint of which the petitioner has sought for rerecommendation of her name for transfer to some other schools.

3. The facts remain that initially vide recommendation of the Secretary, West Bengal Central School Service Commission dated April 12, 2022, the petitioner was transferred to Panchur High School (H.S.), Bidhangar Rabindranagar, South 24-Parganas.

However, Panchur High School (H.S.), Bidhangar

Rabindranagar, South 24-Parganas did not have sanctioned post to accommodate the petitioner.

4. Therefore, the petitioner could not join therein as per recommendation of the Commission as mentioned above.

5. Hence, the petitioner has sought for rerecommendation of her name for transfer to some other suitable school, by dint of letter dated April 19, 2022. Admittedly, the same is yet to be considered by the West Bengal Central School Service Commission.

6. Parties are represented.

7. On the factual back ground as enumerated above in this case, let the writ petition be allowed.

i) Let the respondent West Bengal Central School Service Commission take up the petitioner's application for re-recommendation and decide therein in accordance with law.

ii) The exercise as above should be concluded by the respondent/ West Bengal Central School Service Commission within a period of twelve weeks from the date of communication of copy of this order and after affording reasonable opportunity of hearing to the

petitioner for placing her choice of schools. Its decision shall be informed to the writ petitioner within one week thereafter.

6. The writ petition as above, is disposed of.

7. Since no affidavit is called for in this case, the allegations made in the writ petition, are deemed to have been denied by the respondents.

8. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
