And In Re : Hamida Molla .... petitioner Mr. Souvik Mitter Mr. Sandip Dinda ....for the petitioner Ms. Anusua Sinha ...... for the State Mr. Asit Nayek ....... for the de-facto complainant Learned Counsel appearing for the petitioner submits petitioner is in custody for about 55 days. it is also submitted that he has no direct evidence with regard to the murder of the victim.
Learned Counsel appearing for the State opposes the prayer of the petitioner.
We have considered the materials on record. There was ill-feeling between the petitioner and the deceased i.e. second wife of the co-accused/husband. Petitioner and co-accused husband were present at the residence when the second wife was called there.
In view of the aforesaid incriminating materials and as the principal accused i.e. husband is still absconding, we are of
the opinion that this is not a fit case to grant bail to the petitioner at this stage.
Accordingly, prayer for bail is rejected.
