Mr. Shamik Bagchi, Mr. Farhad Mallick ...for the Petitioner Mr. Debjit Mukherjee ...for WBSEDCL Ms. Sipra Mazumdar, Ms. Somashree Dey ...for the State Learned advocate appearing for the petitioner submits that the petitioner is residing at premises No. Rajpur Government Colony, P.O. - Dakshin Jagaddal, P.S. - Sonarpur, District - South 24 Parganas, along with her two minor children.

It is submitted that due to certain marital discord, the petitioner's husband is residing separately from her. The premises in question, however, is owned by the petitioner's husband, who is a police personnel under the West Bengal Police.

By filing the present writ petition, the petitioner submits that she has no independent source of income to maintain herself and her minor children. Consequently, she is not in a position to pay the electricity bills raised by the West Bengal State Electricity Distribution Company Limited (WBSEDCL). The petitioner apprehends that, due

to non-payment of such electricity bills, the electricity connection at the said premises may be disconnected by WBSEDCL.

It is further submitted that a proceeding under the Protection of Women from Domestic Violence Act, 2005 has been initiated by the petitioner against her husband, and the next date of hearing in the said proceeding is fixed on November 20, 2025, before the learned Trial Court. Having considered the submissions advanced, I am of the view that WBSEDCL cannot be restrained from disconnecting the electricity line at the petitioner's premises if it decides to do so on account of non-payment of electricity bills.

However, the learned Magistrate in the Court below is directed to consider and decide the petitioner's prayer for maintenance in connection with the said proceeding under the Protection of Women from Domestic Violence Act, 2005, as expeditiously as possible, preferably within a period of one month from the date of communication of this order.

This order has been passed in absence of respondent no. 6, since no prejudice is likely to be caused to him by any of the observations made herein.

With the aforesaid observations and directions, WPA

22429 of 2025 stands disposed of.
