Heard the learned Advocates appearing for the parties. Petitioner is in custody for about seven months. He prays for bail.

Learned Advocate for the State opposes the prayer for bail.

We have considered the materials on record. Statement of witnesses and the seizure memorandum show recovery of 115 bottles of phensedyl syrup containing codeine mixtures from the joint possession of the petitioner and the co-accused. In view of the aforesaid fact and the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.
