Petitioner approached this Court for quashing of the proceedings.

In the meantime, a report has been submitted by the State before this Court which reflects that after exhaustive investigation, no evidence could be collected against the present petitioner.

Accordingly, the State is directed to submit the report under Section 173 Cr.P.C. before the jurisdictional court in seisin of the matter.

On instructions, Mr. Sengupta, learned advocate appearing for the State submits that the report under Section 173 Cr.P.C. would be filed before the jurisdictional court within a period of 10 days from date.

Draft report presented before this Court be returned to the learned advocate appearing for the State. However, the report which has been prepared by the Inspector-in-Charge, (DDI, Purba Medinipur DD), CID, West Bengal be kept with the record. In view of the aforesaid, WPA 22099 of 2023 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
