Petitioner complains that police authorities are unnecessarily harassing him because of a photograph uploaded in a social networking site which reflects the petitioner brandishing fire arms. Petitioner claims that the same was a replica of a fire arm which is basically a lighter.

The photographs have been enclosed but so far as the enquiry conducted by the Officer-in-Charge, Jagaddal Police Station is concerned, no information has been furnished to the Superior authorities regarding the grievance.

A report has been submitted by the State which reflects that there are some cases against the

petitioner.

However, learned advocate for the petitioner submits that the said cases have been withdrawn by the concerned defacto-complainant. Be that as it may, if the fire arms which is reflecting in the photographs are subject matter of enquiry it is for the petitioner to explain to the enquiry officer regarding the same.

No case has been registered as yet as is reflected from the report.

Accordingly, petitioner would answer the police authorities by responding to them in respect of the photographs which is the subject matter of enquiry.

Since there has been no coercive steps by the police authorities till date and no case has been registered, I am of the view that it is only a perception that the petitioner is under harassment. In case situation so arise, petitioner will give his representation to the Superior Officer of Police incharge of Jagaddal Police Station. With the aforesaid observations WPA 22843 of 2024 along with CAN 1 of 2024 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
