The learned advocate for the petitioners submits that the hearing of the injunction application and the application under Order XXXIX Rule 4 of the Code of Civil Procedure is pending for a long time. The said learned advocate submits that though the hearing of the injunction application was fixed on September 11, 2023 but the same was not taken up for hearing on that day and the next date has been fixed on 18th December, 2023.

In view thereof, CO 3219 of 2023 is disposed of by requesting the learned Civil Judge (Junior Division), 1st Court at Baruipur, South 24-Parganas to take up the hearing of the injunction application and the application under Order XXXIX Rule 4 of the Code of Civil Procedure, if the same are otherwise ready for hearing on the next date fixed i.e. 18th December, 2023 and to dispose of the same as expeditiously as possible within a period of four

weeks from the next date fixed without granting any unnecessary adjournments to either of the parties. The learned Trial Judge is requested to make an endeavour to dispose of the pending interlocutory applications as expeditiously as possible.

There will be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
