ML 79 15.01.2025 Ct. 14 BP/AGM In The High Court at Calcutta Constitutional Writ Jurisdiction Appellate Side W.P.A 22860 of 2024 Sri Sambhu Charan Koley -versus WBSEDCL & Ors.
Mr. Sabyasachi Hazra.
...For the Petitioner.
Mr. Kunal Ganguly.
Mr. Kaustav Banerjee.
... For the respondent nos. 7 to 11.
Mr. Asif Dewan.
... For WBSEDCL.
1. Perused the report filed by the Station Manager, Begampur C.C.C. WBSEDCL dated 4th December, 2024. It appears therefrom that a spot inspection was conducted to find out an alternative way for effecting electric supply connection to the petitioner.
2. It was noticed that providing electricity connection through the alternative way as proposed is not feasible.
3. The private respondents raised objection with regard to drawing of electric lines through the alleged common passage from where the private respondents are enjoying electricity and water connection.
4. In such a situation, the Court is constrained to direct the District Magistrate, Hooghly to ascertain an alternative way from where electricity line can be drawn for providing electricity connection to the petitioner.
5. A decision shall be taken in the matter by the District Magistrate, Hooghly in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order after giving the petitioner, the private respondents and all other necessary parties an opportunity of hearing.
6. A reasoned order shall be passed and communicated to all the parties.
7. The writ petition stands disposed of.
8. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
