Affidavit of service filed in Court today is taken on record.

The petitioner prays for consideration of his representation seeking 3% additional increment and refixation of his pay in terms of the notification dated 10th February, 2010.

A representation by the petitioner is pending consideration.

The petitioner relies upon the order passed by the Hon'ble Division Bench on 7th January, 2025 in FMA 981 of 2022 with IA No. CAN 1 of 2022 in the matter of Samarendranath Adak -vs- The State of West Bengal & Ors. In support of the submission that he would be entitled to 3% additional increment. 5.

Without entering into the merits of the claim of the petitioner at this stage, the instant writ petition is disposed of by directing the District Inspector of Schools (S.E.), Purba Medinipur to take a decision on the prayer of the petitioner strictly in accordance with law and in line with the law laid down by the Court in the matter

mentioned hereinabove at the earliest but positively within a period of twelve weeks from the date of communication of this order.

The additional increment, if found admissible in case of the petitioner, shall be disbursed without any further delay.

If the prayer of the petitioner is rejected, then the reasoned order indicating the ground(s) of rejection shall be communicated to the petitioner. 8.

The writ petition stands disposed of.

9.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
