2. From the Memo of Evidence as filed by learned advocate for the State, it reveals that proclamation as against the present petitioner was issued on 29.08.2023 while the instant application for anticipatory bail was filed on 11.09.2023.

3. In view of such fact, the instant application under Section 438 Cr.P.C. is not maintainable and is, thus, dismissed.
