Ms. Priyanka Das Mr. Avisek Das ....for the writ petitioner/applicant Learned counsel appearing on behalf of the petitioner submits as follows. By an order dated 09.01.2024 passed by this Court in the writ petition, among other things, the police authorities were directed to keep a sharp vigil at the locale and ensure that no breach of peace took place. In spite of this, on 11.08.2025 some the private respondents entered into the garden of the petitioner and caused severe damage. In spite of intimating this to the concerned authorities, no proper action was taken.

It appears that the order in question was passed on 09.1.2024 granting liberty to the petitioner to file a protest petition before the learned trial Court. However, an additional direction was passed upon the police authorities to keep the sharp vigil at the locale and ensure that no breach of peace took place.

It appears that the first complaint made by the petitioner for a violation of this order was after about one year and seven months from the date of the order. It is clearly a case of arising of a fresh cause of action for which the petitioner shall be at liberty to move the appropriate forum.

Therefore, no further order need be passed in this matter.

The application for contempt is disposed of without any order, even as to costs.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance.
