Mr. Manas Kumar Das Mr. Sumanta Das ...for the petitioner Mr. Bibek Jyoti Basu Mr. Md. Yusuf Ali ...for the State It is the grievance of the petitioner that her son, Soumendra Nath Chakraborty, died in harness on January 15, 2023, while serving as a Sahayak at Sarathi Gram Panchayat, Nadia.

The petitioner claims that she is the sole legal heir of the deceased employee and is, therefore, entitled to receive his terminal benefits.

Mr.

Bibek Jyoti Basu, learned advocate appearing on behalf of the State, on the other hand, submits that the deceased employee was married and that his wife is entitled to receive the terminal benefits.

The aforesaid submission made on behalf of the State is denied by the petitioner.

In view of the disputed questions of fact involved, I am not inclined to keep the present writ petition pending.

It appears that the petitioner has already made a representation before the concerned Block Development Officer seeking release of terminal benefits and pension in her favour. Learned counsel appearing for the petitioner submits that the said representation has not yet been considered.

Accordingly, this writ petition is disposed of with a direction upon respondent no. 3, the Block Development Officer, Kalyani, Jangalgram, Madanpur, Nadia, to consider and dispose of the representation of the petitioner.

The Block Development Officer shall afford an opportunity of hearing to the petitioner as well as to all other concerned parties and, thereafter, pass a reasoned order in accordance with law for release of retiral dues and pensionary benefits in favour of the persons who are legally entitled to receive the same. Accordingly, WPA 22875 of 2024 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
