In the present writ petition, as rightly point out by learned counsel for the WBSEDCL, the final order of assessment in respect of an electricity meter, within the contemplation of Section 126 of the Electricity Act, 2003, has been challenged.

However, as per the law and existing regulations, such a challenge lies under Section 127 of the 2003 Act before the appellate authority.

Hence, this court does not intend to entertain the writ petition.

Accordingly, WPA 22520 of 2022 is disposed of with liberty to the petitioner to challenge the impugned order of final assessment, in accordance with law and subject to the law of limitation, before the appropriate authority.

It is made clear that the merits have not been gone into by this court.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
