29.10.2025 Item No.28 Ct. No. 446 nb CRM(M) 1751 of 2025 In Re:- An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar Police Station Case No.1827 of 2023 dated 3.11.2023 under Sections 395/412/120B of the IPC.

1. Heard the submission of both the learned advocates appearing on behalf of the petitioners as well as for the prosecution.

2. The learned prosecution submitted the memo of evidence. Let it be kept on record.

3. Perused the Case Diary.

4. Other co-accused person are already enlarged on bail. This application has been filed on the ground of parity as well as on the ground of delay in trial.

5. In this regard, the learned advocate rely upon the order passed by the co-ordinate Bench in case other co-accused persons enlarged on bail.

6. On a careful perusal of the Case Diary it is found that number of accused persons, are still at large and the date is fixed for appearance of those accused persons.

7. The Co-ordinate bench while allowed the prayer of a coaccused observed in the month of August 2025 that the case is yet to be committed and prosecution proposes to examine 15

witnesses and there is no remote possibility of completion of trial in future. No further development can be found as of now.

8. Accordingly considering the facts and circumstances and the period of detention, this Court is of the view that further detention of the petitioner is not necessary at present. The prayer of the petitioner stands allowed.

9. Accordingly, petitioner shall be released upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each one of whom must be local, to the satisfaction of the learned CJM, Maldah, and on condition,

10. That he shall appear before the trial court on each and every date of hearing.

11.He shall not intimidate witnesses nor tamper with evidence in any manner whatsoever.

12.The petitioner shall not enter into the jurisdiction of concerned Police Station until further orders and shall submit his address where he shall reside and the mobile number to the officer in charge of the concerned Police Station. 13.In the event the petitioner fails to appear before the trial court, the trial court shall be at liberty to cancel his bail bond without further reference to this Court before the jurisdictional Court on the dates fixed for appearance and in default, the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court 14.Thus, the application for bail in respect of petitioner is allowed. 15.Case Diary be returned.

16. Accordingly, the application being, CRM (M) 1751 of 2025 stands disposed of as allowed.

17. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. 18.Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
