Affidavit-of-service filed in court today be kept on record.

Learned counsel for the petitioner submits that the contract load of the petitioner was 13.16 KVA but it was detected by the WBSEDCL that excess load of 21.9 KVA was being drawn.

Accordingly, upon the WBSEDCL informing the same, the petitioner had applied for enhancement of load. However, a quotation was raised which according to the petitioner is in contravention of Clause 3 of Regulation 46 of the WBERC.

Heard learned counsel for the parties.

Since the matter pertains to a billing dispute, the appropriate authority to resolve the same is the Grievance Redressal Officer (GRO).

Accordingly, WPA 22133 of 2023 is disposed of by granting liberty to the petitioner to approach the concerned GRO to decide the said issue.

If so approached, the GRO shall resolve the issue independently and in accordance with law without being influenced by any of the observations made herein, upon giving opportunity of hearing to all concerned at the earliest, preferably within four weeks from the approach being made.

Liberty is also given to the petitioner to ask for interim reliefs before the GRO.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
