Report submitted by the learned advocate appearing for the State be also kept with the record. Petitioner is aggrieved by the fact that in spite of Balarampur P.S. Case No. 188 of 2025 dated 24.08.2025 having been registered under the relevant provisions of BNS and SC&ST (POA) Act, proper steps are not being taken by the investigating authority.

Learned advocate appearing for the State submits that there are allegations and counterallegations; although case has been registered, two of the accused persons have been arrested in course of the investigation.

Having considered that the case has only being registered on 24.08.2025 and the police authorities are taking steps, I am of the view that as already a superior officer of police is investigating the case, further directions in respect of merits of the investigation at this stage is unwarranted. However, if the petitioner is faced

with inconveniences, threats and insecurity, in that case petitioner will inform either the jurisdictional special court or to the superior officer who is investigating case. The threat perception of the petitioner would be considered and thereafter if required, appropriate measures be taken either by the court or by the investigating officer of the case. With the aforesaid observations, the writ petition being WPA 22383 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
