And In Re : Parvej Khan ........ petitioner Mr. Amitabha Karmakar Mr. A. K. Bhowmick ...... for the petitioner Mr. Neguive Ahmed Mr. Iqbal Kabir ...... for the State Petitioner is in custody for 11 months. He prays for bail. Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record and statements of witnesses implicating the petitioner in the crime. Petitioner had control and dominion over the tanker which was driven by the deceased. He negotiated with the persons to sell oil which was stolen from the tanker.

In view of the aforesaid incriminating materials we are of the opinion this is not a fit case to grant bail to the petitioner at this stage.
