Affidavit-of-service filed by the petitioner is taken on record. Despite service, although the State is represented, none appears for the private respondents.

The petitioner alleges that the respondent nos. 5, 6 and 7, who are the owners/occupiers of different flats of a multi-storied building, are running a pet clinic from the garage of the said multi-storied building without taking permission from the appropriate authorities. The petitioner lodged a complaint before the Maheshtala Municipality as well as with the Inspector-inCharge of Maheshtala Police Station by a letter, which was received by the office of the Inspectorin-Charge of Maheshtala Police Station on September 1, 2024.

The learned Advocate appearing for the Sate files a report of the Inspector-in-Charge of Maheshtala Police Station dated September 27, 2024, which is taken on record.

From the said report it appears that upon enquiry it revealed that the respondent no. 7 could not produce any document to show that he has obtained any permission/licence from the appropriate authorities for running a pet clinic. The report further states that the respondent no. 7 claimed that he was decorating the said garage to run a pet clinic and after the petitioner raised an objection he stopped the work of decoration. The report further states that the pet clinic was not functional at the time of enquiry.

In the event, the respondent nos. 5, 6 and have not obtained any requisite permission/licence/NOC from the competent authority for running a pet clinic, the Inspector-inCharge of Maheshtala Police Station shall take steps to restrain the private respondents from running any pet clinic.

With the above observations and directions, the writ petition stands disposed of. Photostat certified copy, if applied for, be given to the parties.
