1. The grievance of the petitioner is directed against an order dated 15th September, 2022 passed by the Ombudsman.

2. On behalf of the WBSEDCL it is submitted that the order has been partially implemented.

However, the petitioner is yet to pay the balance amount in terms of the said order.

3. On behalf of the petitioner it is submitted that subsequent to the passing of the impugned order a fresh electric meter had been installed which has been damaged.

4. In view of the above, WPA/22148/2023 stands disposed of by granting liberty to the petitioner to file a fresh complaint insofar as the damaged meter before the respondent no. 2 in accordance with law.

5. If such representation is made, the same shall be considered within four weeks from the date of receipt thereof.

6. It is made clear that the above order will not stand in the way of the WBSEDCL to take necessary steps for recovery of the balance amount in accordance with law.

7. It is made clear that there has been no adjudication on the merits of the case and all questions are left open to be decided in accordance with law.
