Learned Government Advocate has placed before us a report dated 12.01.2021 made by Officer-in charge, Durgapur Police Station.

We take that report on record.

It is pointed out that the victim girl has made a statement under Section 164 Cr.P.C. and consequently, a final report has been placed on the premise that the case was initiated on a mistaken fact since the statement recorded under Section 164 Cr.P.C. made by the alleged victim stated that she went on her own.

We record this submission and dispose of the writ petition leaving open all issues, if at all they arise for decision in appropriate jurisdictions.
