1. The petitioner is the widowed daughter of one Balaram Mondal, Ex-Assistant Teacher of Nawsha Free Primary School, who died on 8th January, 2020. The petitioner's husband, namely, Subra Baran Halder had died prior thereto on 14th June, 2014.

2. The Joint Director, Pension, Provident Fund and Group Insurance, Finance Department, Government of West Bengal has asked for an affidavit and/or declaration from the petitioner that the petitioner is not drawing any pension whatsoever from any Government undertaking and was also required to submit her voter's card and ration card.

3. It is submitted that the petitioner has already submitted the same and the documents are annexed to the writ petition at pages 24, 25 and 26.

4. In view of the above, this Court directs the Director of Pension, Provident Fund and Group Insurance, West Bengal to issue a Pension Payment Order in

favour of the petitioner from the date of death of her late father, namely, Balaram Mondal, i.e. 8th January, 2020 within a period of one month from the date of receipt of a copy of this order.

5. All the arrears of pension shall be paid to the writ petitioner within a period of two months from date together with interest at the rate of six percent per annum on the delayed payment of arrears.

6. With the aforesaid directions, the instant writ petition shall stand disposed of.

7. There will be no order as to costs.

8. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
